GENERAL TERMS AND CONDITIONS OF SALE (GTC).
Article 1: This contract is intended for the exclusive use of booking stays in our
""Les Iles Vagabondes"" guest house located in Saint-Malo in Brittany. It is
established solely between the client and the guest house ""Les Iles Vagabondes"".
The T&Cs apply exclusively to reservations made directly,
by telephone, by mail, by email, via our website or on that of the Saint-Malo – La Baie du Mont Saint Michel Tourist Office.
These T&Cs may be modified at any time, without notice, and are in
effective on the date reservations are made.
Article 2: Length of stay : the client who signs the contract drawn up for a fixed period and binding us, may not claim any right to remain on the premises.
Article 3: No right of withdrawal : For reservations made by mail, by
telephone, by email or online via our website or that of the Saint-Malo - La Baie du Mont Saint-Michel Tourist Office,the customer does not benefit from the withdrawal period, in accordance with article L-121-21-8 of the consumer code relating in particular to hosting services provided on a specific date or at a specific frequency.
Article 4: Booking terms : The prices mentioned on our website, on that of the Saint-Malo-La Baie du Mont Saint Michel Tourist Office or on simple request by telephone or email, valid for reservations made directly, by telephone, by mail, by email, on our website or on that of the Saint-Malo-La Baie du Mont Saint Michel Tourist Office, and charged in euros, are applied per room, per night and breakfast service included, all taxes included. The tourist tax and the ""Relaxation Area"" service upon reservation are not included in the price per night, which must be paid directly on site. These rates may be modified at any time, without notice and only those mentioned in the contract when the reservation is effective are valid.
Regarding reservations:
For information: for any reservation request made on our website or on that of the Saint-Malo- la Baie du Mont Saint Michel Tourist Office, via our Channel Manager ELLOHA (who, subsequently and initially, sends an email to the customer who initiated this request), a credit card imprint is requested as a guarantee. No charge is made to this credit card. This guarantee is likely to operate mainly when there is a no-show of the customer who made a reservation request through our site (for payment of the remaining balance or, depending on the case, the entire stay).
Secondly, the procedures for confirming this reservation request made by telephone, by mail, by email, on our website or on that of the Saint-Malo-la Baie du Mont Saint Michel Tourist Office (signing a quote and requesting a deposit, etc.) are given in a second email sent by us from contact@les-iles-vagabondes.fr
- Any reservation made directly by telephone, by mail, by email, on our website or on that of the Saint-Malo-La Baie du Mont Saint Michel Tourist Office, is confirmed when a deposit corresponding to 30% of the total amount due (excluding tourist tax) is paid and received. The remaining balance due, tourist tax included, is to be paid on site during the stay.
- Any reservation made directly on site, by telephone, by mail, by email, on our website or on that of the Saint-Malo-La Baie du Mont Saint-Michel Tourist Office, on the same day as the start of the stay and this, depending on availability, is due in full upon arrival.
Payment methods:
For any reservation made directly by telephone, by mail, by email, on our website or on that of the Saint-Malo-La Baie du Mont Saint Michel Tourist Office, the following payment methods are accepted: bank transfer, bank check, cash, ANCV holiday voucher or by credit card directly on site.
The reservation is confirmed upon receipt of payment due, either of the deposit or of the total amount (for payments by bank check, following its collection), and you are notified by email or by telephone.
The deadline for sending payment to confirm your reservation is 5 business days. After this period, the reservation is canceled.
For a reservation made directly, on the same day as the start of the stay, on site, and subject to availability, payment can be made by check, cash, credit card (MasterCard or Visa) or ANCV holiday voucher.
Article 5: The additional ""Relaxation Area"" service must be booked on site upon arrival, subject to availability, and must be paid for at the end of your stay. Advance reservations are available upon request. Payment is due at the end of your stay. Cancellation of this service is free of charge.
In the Relaxation Area, up to 5 people maximum are accepted knowing that the capacity of the SPA is 4 people maximum at the same time and the capacity of the SAUNA is 3 people at the same time.
Article 6: Tourist tax : tax/night/adult (Adult aged 18 and over): local tax, it is payable in addition to your stay and this, for any person not domiciled in Saint-Malo (35400), a municipality which is part of the Communauté d'Agglomération du Pays de Saint-Malo, recipient of this tax. We will take care of paying it to them.
The amount of this tourist tax may be reviewed at any time by the Saint-Malo Urban Community. If this amount is changed, it will be applied as soon as it is implemented.
Article 7: Cancellation conditions following a direct reservation, by telephone, mail, email, on our website or on the Saint-Malo tourist office website. These cancellation requests must be sent by telephone, mail or email.
- CANCELLATION up to and including the 31st day before the start date of your stay with us: the deposit or, if a full payment has been made, will be fully refunded.
- CANCELLATION from the 30th day up to and including the 21st day before the start date of your stay with us: the 30% deposit is retained regardless of the number of nights . For the same number of nights, if a full payment has been made, only an amount corresponding to 30% of the total amount will be retained. The remaining balance will be refunded to you.
- CANCELLATION between the 20th day and the 8th day inclusive before the start date of your stay with us: 50% of the total amount is retained regardless of the number of nights . The remaining balance will be refunded to you.
- CANCELLATION between the 7th day and 2 days before the start date of your stay with us: 70% of the total amount is retained regardless of the number of nights . The remaining balance will be refunded.
- CANCELLATION THE DAY BEFORE OR IN CASE OF NO-SHOW on the start date of the stay: the total amount of your reservation will be retained regardless of the number of nights. No refund will be issued.
- In the event of a shortened stay, the total amount of your reservation is retained, regardless of the number of nights.
- CANCELLATION THEN POSTPONED THE STAY TO A LATER DATE SUBJECT TO AVAILABILITY: the 30% deposit is retained and the remaining balance due takes into account the new rate offered at the time of the new reservation, in the event that the previous and cancelled reservation was made at the latest 21 days before the start of the cancelled stay.
Likewise, if the cancellation is made between the 20th day and the day the cancelled stay begins and is followed by a postponement of the latter, the full amount paid is retained. In this case, if the new reservation corresponds to a different period, a surplus may be requested or a refund may be made to you.
If the period of the new reservation is the same, the rate remains the same if it is not changed.
Regardless of the period, if between a cancellation followed by a postponement and the new reservation, there is a change in prices upwards, the customer agrees to pay the difference.
Article 8: Conditions of cancellation by us : When we cancel your stay before it begins, we must inform you by any means at our disposal, whether by telephone, email, post, etc.
2 possibilities are offered to you under these conditions:
- You will be fully reimbursed for the total amount you paid.
- An amicable agreement is concluded between you and us following your acceptance of a replacement stay that we offer you, without compensation.
Article 9: Gift cards : these cards are valid for 1 year from the date of purchase, for stays outside high season (July-August and early September) or exceptional season (the Route du Rhum, etc.). Beyond their expiry date, these cards are no longer valid and cannot be refunded.
These gift cards are valid for 1 to 5 people maximum and for a minimum of one night.
The price does not include tourist tax, which must be paid at the end of the stay by the person(s) receiving these gift cards.
The price of these cards corresponds to the price of one night's stay in mid-season multiplied by the number of nights chosen, and it varies depending on the rooms and the maximum number of people per room. To this price, the price in effect at the time of purchase for a SPA or SPA&Sauna service may be added.
Gift card requests can be made by phone or email. Following an agreement between us and the buyer, and once the amount of the gift card has been paid and received, the gift card is sent, at our expense, by post to the buyer's chosen recipient.
Article 10: Arrival : The client must arrive on the day and at the times specified in the contract. If there is a change in schedule on the specified day, the client must notify us by phone or email.
If there is a change to the arrival date, the total amount of the reservation is retained by us without any possibility of reimbursement.
Article 11: Use of the premises : the client agrees to respect the internal regulations readable on the site when the latter are effective, or available in our reception room.
On request, we can send it to him by email.
Article 12: Capacity : this contract is defined for a specific number of people.
If one or more people are missing on the day of arrival, no refund can be claimed and the total amount of the reservation is retained by us.
If this number is exceeded on the day of arrival, we are entitled to refuse the additional person(s) without this being a breach or modification of the contract on our part. In this case, no refund is possible after the customer's departure or at the end of their stay.
Article 13: Animals : As we have animals ourselves, the presence of other animals in our guest room ""Les Iles Vagabondes"" is not accepted.
If on the day of arrival, the client arrives with one or more animals, we are entitled to refuse them, without this resulting in a breach or modification of the contract on our part. In this case, no refund is possible after departure due to the customer or at the end of the stay.
Article 14: Disputes : in matters of disputes, only the judicial court of Saint-Malo has jurisdiction.
